Information on Data Transfer to Third Countries with Inadequate Data Protection and to US Companies Not Certified Under DPF
We use, among other things, tools from companies based in third countries with inadequate data protection as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to these countries and processed there. We point out that no level of data protection comparable to that of the EU can be guaranteed in third countries with inadequate data protection.
We note that the USA, as a secure third country, generally has a level of data protection comparable to the EU. Data transfer to the USA is permissible if the recipient is certified under the “EU-US Data Privacy Framework” (DPF) or has suitable additional safeguards. Information on transfers to third countries, including data recipients, can be found in this privacy policy.
Recipients of Personal Data
In the course of our business activities, we collaborate with various external entities. This sometimes requires the transfer of personal data to these external entities. We only transfer personal data to external entities if this is necessary for contract fulfillment, if we are legally obligated to do so (e.g., transferring data to tax authorities), if we have a legitimate interest under Art. 6(1)(f) GDPR in the transfer, or if another legal basis permits the data transfer. When using data processors, we only transfer personal data of our customers based on a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.
Revocation of Your Consent to Data Processing
Many data processing operations are only possible with your explicit consent. You can revoke consent you have already given at any time. The legality of the data processing carried out prior to the revocation remains unaffected by the revocation.

THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR THE PROCESSING SERVES THE ASSERTION, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.
Right to Data Portability
You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.

You have the right to request the restriction of the processing of your personal data. You can contact us at any time regarding this. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored with us, we usually need time to verify this. During the verification period, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
- If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
- If you have objected pursuant to Art. 21(1) GDPR, a balancing of your and our interests must be carried out. As long as it is not yet clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the assertion, exercise, or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively based on this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent can be revoked at any time.
You can set your browser to inform you about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. Disabling cookies may limit the functionality of this website.

In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries directed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be revoked at any time.

Processing of Data in AI Services
Our platform xpandAI provides you with access to various AI services via standardized APIs. In doing so, we process personal data in our own systems in full compliance with the provisions of the GDPR. The following information applies if you use our AI services:
External API access to language models:
We provide access to external language models offered by third-party providers (e.g., OpenAI, Anthropic). Some of these models are secured through data processing agreements (DPAs) and are operated on servers located in Germany or the EU. For other models, no such agreement exists, and data processing may take place in third countries. In such cases, we provide transparent information about the scope and risks of the data processing.
Use of system prompts and vector databases:
Within our assistant solutions, we use so-called system prompts to configure requests to the underlying AI models. These prompts serve as a preliminary instruction and do not modify the models themselves. Optionally, company data can be integrated via a vector database for use within the assistants. Data is processed exclusively for the purpose of providing the agreed services. Providers such as OpenAI are covered by appropriate data processing agreements.
Transparency obligations under the EU AI Act:
xpandAI fulfills the transparency obligations of the EU AI Act by clearly labeling all AI-generated content. Users are informed whenever they interact with an AI system. There is no guarantee regarding the factual accuracy or legal applicability of the generated content. Final review and use are the responsibility of the user.
Risk management and feedback:
We document internal measures for risk prevention and monitoring in accordance with the EU AI Act. If problematic or discriminatory AI outputs occur, users can contact us via support@xpand.pro or the platform's feedback function. xpandAI reviews such reports and initiates appropriate actions if necessary.
Responsibilities:
xpandAI does not train its own AI models but provides access to existing external systems. The primary data protection responsibility for the respective model processing lies with the model provider—unless a data processing agreement is in place. We provide transparent information on our website about the systems used and their technical and data protection characteristics.
